Unfair terms legislation passes the Senate

The Trade Practices Amendment (Australian Consumer Law) Bill 2009 (Cth) (Bill) passed the Senate this morning.

All of the government’s proposed amendments were passed. The amendments proposed by the Opposition and Senator Nick Xenophon were rejected in the Senate.¹ 

The Bill will now go back to the House of Representatives (House) for the House to consider the amendments passed by the Senate. It is intended that the Senate amendments will go before the House shortly.

If the House accepts the Senate amendments, the Bill will receive Royal Assent and become law.

We will follow up with some commentary on the Senate amendments shortly.
