- We acted for the consortium selected to build, own, operate and transfer Stadium Australia at Sydney Olympic Park, Homebush, the main venue for the Sydney 2000 Olympic Games. The project comprised negotiating the franchise to build, own and operate the Stadium; construction documentation; debt financing; packaging stapled securities (comprising units in an infrastructure trust and shares in the operator) with club membership rights and Olympic ticket entitlements; issuing prospectuses; and listing of the securities.
- We acted for Staged Development Australia on the Melbourne City Square mixed development comprising a car park, hotel, apartment and retail stores, as well as the refurbishment of the historic Regent Theatre.
- We acted for Mayne Group Ltd in the construction and operation of new health facilities at the Joondalup Regional Health Campus. This project was unique in Western Australia and involved a high level of cooperation between government and the private sector.
- We acted for the West Australian Government on this project from the pre-contract stage leading up to the award of a design and construct contract. This involved preparing a draft contract, reviewing the requirements contained in the proposal request, and meeting with lawyers representing the preferred proponent. The Acacia Prison will be the largest prison in Western Australia and the first to be privately operated.
- We advised Lend Lease Development on all aspects of the Jacksons Landing residential and commercial development at Pyrmont in Sydney.
- We advised Transfield and Kumagai Gumi in the $500 million BOT construction (on toll basis) of the Sydney Harbour Tunnel. The project involved unique consumer price index-based financial instruments issued on the financing and funding of the Sydney Harbour Tunnel.
- We acted for the Lend Lease, Lyonnaise de Eaux Dumez and P&O consortium selected for the Sydney Water Board's $240 million BOOT development and financing of the Prospect Water filtration plant in New South Wales. We drafted or reviewed all documentation for this project, the largest treatment plant to date in the Southern Hemisphere.
- We acted for the successful Transurban consortium in relation to the $1.7 billion Melbourne City Link project, Australia's largest privately funded infrastructure project (1996 Euromoney Finance Deal of the Year). This project involved negotiating and settling project agreements as well as equity and debt documents, managing the due diligence process, drafting and preparing the prospectus and public float, and providing all related revenue advice, which included a complex and innovative structure of stapled securities. The project achieved world benchmarks in legal/commercial risk allocation between the public and private sectors (and among equity, debt, contractor and operator).
- We also represented Transurban by leading their legal team in all phases of the Exhibition Street extension tollway, which joins the Melbourne City Link tollway.
- We have advised the Victorian Government on various gas infrastructure developments, including the augmentation of the New South Wales–Victorian Interconnector, the South-West Pipeline and the Murray Valley Pipeline.
- We advised the financiers to the developers of the NextGen fibre optic cable project. This involved a $700 million project financing for the cable, which will run from Perth through to Adelaide and Sydney.
- We acted for the sponsors of the $2.2 billion Compact Steel and $4.5 million Enviropower projects relating to the development of a steel mill expected to produce some 1,670,000 tonnes of steel per annum.
- We advised Hamersley Iron on their significant involvement with the establishment, construction and operations of the contractor-operated mine at Brockman and the iron ore mines at Marandoo and Yandi. In addition, we advised Hamersley on its Paraburdoo Fines Processing Plant. Currently we are advising another Rio Tinto subsidiary, North Ltd, on the development of the West Angelas project.
- We advised Homestake with the construction of the Cowa mine in New South Wales.
- We are advising Transurban in relation to the Melbourne City Link dispute regarding the City Link freeway infrastructure and tollway system, including the negotiation of various standstill agreements.
- We acted for Walter Constructions in relation to the resolution of the multi-party dispute regarding the Victorian Arts Centre spire.
- We acted for the OneLink consortium in relation to its dispute with the Public Transport Corporation regarding the Victorian tram, train and bus automated ticketing systems, involving complex engineering and systems issues.
- We acted for Olex Cables in an international arbitration regarding a major pipeline project in India, including substantial document management for arbitration proceedings in Switzerland.
