Some of our recent significant matters are described below.
AAPT
We have acted for AAPT and TCNZ in respect of a range of infrastructure access pricing disputes under Part XIC of the Trade Practices Act, including arbitrations before the ACCC and the Australian Competition Tribunal. Our work has also covered anti-competitive conduct issues and law reform, involving important and novel issues in law, economics and regulatory policy.
Sydney Airport Privatisation
Freehills advised the Commonwealth Office of Asset Sales & Corporate Services in relation to the economic regulation of Sydney Airport, for the purposes of the Scoping Study for the sale of Sydney Airport and also for the purposes of the sale process itself. This involved a consideration of the regimes applicable under the Airports Act and Prices Surveillance Act as well as Part IIIA of the Trade Practices Act.
Visa
We act for VISA in relation to the designation of open loop payment systems under the Payment Systems (Regulation) Act and the proposed imposition of an access regime on the participants in that system by the Reserve Bank of Australia.
C7
We act for C7 Pty Ltd (a company in the Seven Network group) which is seeking access to analogue pay TV services. The ACCC is currently conducting arbitrations in relation to this matter.
