Current practice

Haydn has recently returned to Freehills after spending 11 years working for Soemadipradja and Taher, Freehills’ correspondent firm in Jakarta, Indonesia as a foreign counsel.

Haydn joined Freehills’ Sydney office in 1987, and accepted an invitation to join that partnership in 1997.

Industry experience

 

Haydn was seconded to Soemadipradja and Taher in 1993 and has gained extensive experience in the workings of the Indonesian legal system from acting for both foreign and Indonesian clients. Haydn has advised on all manner of different projects, including  resources projects including oil and gas, coal and gold mining; the privatisation of the Jakarta water supply and power projects.

Multi-lateral and infrastructure expertise

  • Adviser to the consortium that gained two World Bank water supply mandates for Indonesia; the Jabotabok Water Project and the National Water Project.
  • Adviser to PT CEPA Indonesia in relation to the Tanjung Jati B Power Project who were selected to develop a US$1.9 billion coal fired power station in Indonesia.  The work involved settling extensive project agreements with the Indonesian government and coordinating the land acquisition program.

Project finance

  • Adviser to PT Excelcomindo in Jakarta on the restructuring of its foreign debt, involving  negotiating documentation in relation to the refinancing of foreign debt and Indonesian security documents.
  • Adviser to  PT Newmont Nusa Tenggara in relation to the construction and financing of the US$2 billion Batu Hijau mining project in Indonesia.
  • Adviser to PT Indomura Kencana in relation to the construction and financing of the Mt Muro mining project in Indonesia.

Haydn’s experience also covers the first securitisation of receivables in Indonesia, Eurobond issues, funds management, technology licensing and distribution arrangements; bankruptcy and corporate reconstructions, and investment in and leasing of commercial buildings and shophouse, office park, shopping centre and retail developments.

Professional background

Haydn is a member of the Australia Indonesia Business Council and has lectured at Indonesian universities on various issues including Indonesian foreign investment regulation. He has a Bachelor of Economics and a Bachelor of Laws from Sydney's Macquarie University and is admitted to practice in New South Wales.
