Current practice
Chris acts for employers in a broad range of industries including mining, stevedoring, transport, manufacturing, retail, IT, banking and finance.
A significant part of his practice involves employment litigation, including proceedings for wrongful dismissal, unfair dismissal, breach of confidence, restraint of trade, unfair contracts as well as prosecution proceedings involving breaches of awards, employment legislation and occupational health and safety legislation.
In addition he advises clients in relation to enterprise bargaining, industrial disputes, award coverage, occupational health and safety matters and discrimination complaints. Chris appears as an advocate in court proceedings and in proceedings before state and federal industrial tribunals.
Industry experience
Chris advises on a wide range of employee relations issues, by way of example:
- advising employers in relation to:
- employment contracts, right of termination, redundancies, unfair dismissals
- outsourcing and privatisation including transfer of employment, transmission of accrued rights and entitlements
- the termination of employment of senior executives including the investigation of employee misconduct, whistleblowing, employee fraud
- the rights of injured employees including rights in respect of workers compensation claims, total and permanent disability claims, rehabilitation and unfair dismissal
- the investigation of safety incidents in the workplace and representing employers in prosecution proceedings for breach of occupational health and safety legislation
- complaints brought under federal and state anti-discrimination legislation, and representing clients in proceedings before the New South Wales Anti-Discrimination Board and the Human Rights and Equal Opportunity Commission and in court proceedings.
- drafting senior executives service agreements and advising employers in relation to corporate governance issues, executive remuneration, employee share schemes
